FERRARI TOUR COMPETITION TERMS AND CONDITIONS

1. COMPETITION NAME AND ORGANISER
The Ferrari Tour Competition (the “Competition”) is organised by Ferrari Australasia Pty Ltd (ABN 90 160 706 141) in collaboration with Save the Children Australia (ABN 99 008 610 035) ("we”, "us”, “Ferrari”, or "the Organiser").
2. KEY DETAILS

Competition Period: Starts 10:30am (AEST) on 22 March 2024 and ends at midday (12.00pm) (AEST) on 24 March 2024.
Prize Draw: This is a game of chance and skill plays no part in determining the winner. The prize draw will take place at or around 2:00pm (AEST) on 24 March 2024 at the Melbourne Grand Prix, located at the Albert Park Circuit, Melbourne, Victoria 3206. The first one (1) valid entry randomly drawn will receive the Prize.
Prize: There is one (1) available prize to be won in this Competition, for the Tour (defined below) valued at $20,000.00.
Tour: The winner will be invited to attend Ferrari’s Annual Tour for 2024, a two to three (2-3) day driving tour experience where the winner will drive convoy style in their personal Ferrari to various destinations (including country wine regions) around the South Island of New Zealand. This includes free transportation of the winner’s Ferrari (from Sydney or Melbourne), premium food and beverage offerings, deluxe accommodation and pop-up entertainment events hosted by Ferrari, alongside the President of Ferrari Australia and other Ferrari owners and personnel. For the avoidance of doubt, flight costs as well as transport costs for the winner’s Ferrari to Melbourne or Sydney (if required) are not included in the Tour.
Publication of Winner: The winner’s name and state, territory or country of residence will be published on the Competition Website from this date and may also be published on other websites or locations at the Organiser’s discretion.
Notification of Winner: The winner will be notified via the email or phone number supplied in the form on the Competition Website on [24 March 2024]. If a winner does not respond to their notification method, the Organisers will use reasonable steps to re-contact the winner via the email and phone number supplied.
3. APPLICATION OF TERMS & CONDITIONS
These terms and conditions (“Terms”) apply to those (“you”, “entrant/s”) who enter into the Competition. We may vary these terms and conditions by posting them on the Ferrari website (located at [https://ferrari-insurance.com.au/competition/]).
4. ENTRY
- By entering the Competition, you accept these Terms and Conditions.
- Entry into the Competition is open only to entrants who comply with the Entry Requirements.
- To enter the Competition, entrants must follow the Entry Mechanic (as outlined in clause 6 below).
- Entrants can only enter the Competition once during the Competition Period.
- For the avoidance of doubt, it is a breach of these Terms and Conditions to enter a fake name, email, phone number whilst entering the Competition.
- The Organiser reserves the right to verify that entrants have used their correct name and personal details when entering the Competition or at any time thereafter.
- Entries must be received by Ferrari during the Competition Period.
- Ferrari accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
- Ferrari has no control over communications networks or services, the internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to technical malfunction or otherwise.
- Ferrari is not liable for any consequences of user error including (without limitation) costs incurred.
- As a condition of entry, entrants must consent to the use of personal information (name, email address and phone number) for direct marketing purposes, such as such as offering new Ferrari products and services and notifications of developments to existing Ferrari products and services. If a person does not wish to consent the use of personal information as listed in this clause, the person should not enter the Competition.
5. ENTRY REQUIREMENTS

Entrants to the Competition must satisfy all of the following criteria:
- hold a valid ticket to the 2024 Melbourne Grand Prix;
- own a Ferrari vehicle which is in good working order and capable of being transported to the location of, and participated in, the Tour;
- be legally allowed to visit and drive in New Zealand;
- must be available to attend the Tour;
- be at least 18 years of age; and
- follow the Entry Mechanic.

Directors, management, employees, officers and contractors (and their Immediate Families) of:
- Ferrari; and
- the agencies or companies associated with this Competition, are ineligible to enter.
- For the purpose of clause 5(b), Immediate families means spouse, parent, natural or adopted child, and sibling (whether natural or a dopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.
6. ENTRY MECHANIC

To enter, entrants:
- must scan the QR code available on various strut cards, brochures and A-5 flyers located in the Casa Ferrari Marquee at the 2024 Melbourne Grand Prix;hold a valid ticket to the 2024 Melbourne Grand Prix;
- complete all required text fields in the form on the Competition Website; and
- accept the terms and conditions and subscribe to receive updates, news and marketing materials from Ferrari to the supplied email address and phone number.
- (together, the “Required Information”);
- It is the responsibility of each entrant to notify the Organiser of any change to their contact details.
- Entries are deemed to be received at the time and on the date that the entrant supplies the Required Information via the Competition Website.
7. PRIZE DRAW
- Ferrari’s decision in relation to all aspects of this Competition is final and no correspondence will be entered into.
- The Prize will be awarded to the winner drawn in accordance with the Prize Draw.
- The winner will be notified in accordance with the Notification of Winner.
- The Tour will take place in New Zealand over a 2-3 day period between September- November 2024, with exact tour dates to be determined by Ferrari in their sole discretion.
- Ferrari may, in its sole discretion, disqualify any or all entries from, and prohibit further participation in this Competition by, any person who fails to provide adequate identification to the satisfaction of Ferrari, or who tampers with or benefits from the manipulation of, or tampering with, the Entry Mechanic or the operation of the Competition or acts in violation of these Terms and Conditions, acts in a disruptive manner, is drunk or disorderly, or acts with the intent to annoy, abuse, threaten or harass any other person.
- If, due to any reason whatsoever, Ferrari becomes aware after an entrant has won a Prize that the entrant has not complied with these Terms and Conditions, Ferrari reserves the right to revoke the Prize, even if Ferrari has announced them as a winner and published their name on the Competition Website. The Organiser may at its sole discretion then conduct such further draws of the Prize.
- If the winner fails to respond within 28 days of the Notification of Winner procedure, subject to any written directions by a relevant authority, the Organiser may at its sole discretion deem the Prize forfeited and conduct such further draws until a further winner confirms acceptance of their Prize.
- The Prize is not transferable.
8. PRIVACY
- The information entrants provide will be used by Ferrari for the purpose of conducting this Competition. By entering this Competition and in accordance with the Privacy Policy (link to the policy is found in clause 8(c) below), entrants’ consent to the storage of their personal information on the databases of Ferrari and its related bodies corporate and Ferrari and its related bodies corporate may use this information for future promotional and marketing and data research purposes regarding their products and services including (where the entrant has opted in) contacting entrants via electronic messaging.
- Ferrari may disclose entrants’ personal information to its contractors and agents to assist in conducting this Competition or communicating with entrants.
- Entrants can read Ferrari’s Privacy Policy at https://www.ferrari.com/en-EN/privacy-policy (Privacy Policy). Entrants can contact the Ferrari’s Data Protection Officer through Ferrari’s interactive webform (here).
9. GENERAL
- If for any reason any aspect of this Competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Organiser, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, the Organiser may in its sole discretion cancel, terminate, modify or suspend the Competition.
- Without limiting any other paragraph and subject to your rights under the Australian Consumer Law or otherwise at law, the Organiser may at its discretion vary any aspect of this Competition or of these terms, including cancelling the Competition.
- In the event the winner cannot attend the 2024 dates of the Ferrari Annual Tour, the winner must provide Ferrari with reasonable written notice of this inability to attend (email to suffice). The Organiser may then at its sole discretion deem the Prize forfeited and conduct such further draws until a further winner confirms acceptance of their Prize.
- Nothing in these Terms and Conditions, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act (Cth) (“Non-Excludable Guarantees”).
- The Organiser and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Competition, or accepting or benefiting from any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law) including the Non-Excludable Guarantees.
- Ferrari accepts no responsibility for any tax implications that may arise from the Prize. Independent financial advice should be sought.
- A reference in these Terms and Conditions or in any advertisement relating to this Competition to ‘dollars’ or ‘$’ is a reference to the lawful currency of Australia.
- The words ‘such as’, ‘including’, ‘particularly’ and similar expressions in these Terms and Conditions are not used as, nor are they intended to be interpreted as, words of limitation.
